Rules, Regulations and Fines
LAKE TYEE RULES AND REGULATIONS
Effective: June 23, 2007
The manager or designee
is authorized to establish and enforce rules of conduct and safety,
which will stand as valid until and subject
to the approval or modification of the Board of Directors.
Fines shall be paid within fifteen (15) days after receipt by the
owner and will be deemed delinquent thereafter. Non-payment may result in a lien against lot owner’s
property.
1.
Vehicle Operation: Vehicular traffic is allowed only on designated roads.
All owners and guests must have a visible Lake Tyee sticker or guest pass. Speed limit is 10 MPH
on two-lane roads and 5 MPH on one-lane roads. Fine Structure:
a. Speeding fine structure: 1st violation: warning, 2nd violation $50, 3rd violation
$100, 4th and subsequent
violations $200.
b. failure to stop at “STOP” signs: 1st violation:
warning, 2nd and subsequent violations $25 fine.
c. failure to use “care
and caution” (example: passengers body extended outside of vehicle). 1st violation warning, 2nd
and subsequent violations $50 fine.
d. driving or parking in prohibited area (example: grass, lakeshore,
etc.). Fine Structure:
1st violation warning; 2nd and subsequent
violations $50.

Firearms (including bb and pellet guns): no firearms are permitted or may be discharged
within Lake Tyee. Any use or display of firearms within Lake Tyee intended to threaten
or intimidate a resident, guest, staff, or other person who is lawfully on any property within Lake Tyee will immediately
be reported to the Sheriff’s office. Fine Structure: 1st and subsequent violations: $1000
and referral to the Sheriff’s office.
3 Fireworks: any and all types
of fireworks are forbidden to be discharged within the confines of Lake Tyee. Fine: $500 per occurrence.
4. Fires during
Open Burning: pits, barbecues and other fireplaces or fireplace devices shall be subject to the
inspection and approval of the manager or designee. Fires shall not be left unattended and shall be drowned
by the maker on leaving. Fine for unattended fire: 1st violation warning; 2nd
violation $100; 3rd and subsequent violations $200. In any event, fire regulations set by
the manager or designee or closure by the state and/or federal government must be observed.
5. Fires during a Burn
Ban: Lake Tyee has adopted Skagit County’s burning regulations, which state that no
outdoor burning, meaning no open flame, is permitted during a “Burn Ban”.
This includes but is not limited to fireplaces, fire pits, fire rings, tiki torches, candles and all propane operated
fire pits (two examples are shown below). Cooking on a propane fire pit during a burn ban is not an acceptable excuse. The
only exception to this is commercially built propane, electric or charcoal BBQ’s while used for cooking.
Fine for burning during a burn ban: $500 each occurrence and Fire Department will
be contacted. You will be liable for all costs incurred due to their response.
6. Unauthorized Garbage
in Dumpsters: only kitchen garbage may be placed in the dumpsters. All other
disposable material such as furniture, mattresses, barbecues, appliances, propane bottles, etc., need to
be taken off-site by the owner. Fine: $500 per occurrence.
7. Motors:
no internal combustion motors of any kind are allowed on the lake for any purpose except that the manager of Lake Tyee
may authorize their use by our employees for lake maintenance or patrol. Owner’s boats must be stored
in the designated areas. Fine: 1st violation $100 and loss of lake privileges for the day; 2nd
and any subsequent violation $250 and loss of lake privileges for one year.
8. Pets: all pets shall be under the owner’s control
at all times and on a leash when off the owner’s lot. No animals are allowed in the clubhouse.
Off-leash area is located in pit. Owners must clean up after your pet. Fine
for unleashed pet: 1st violation warning; 2nd and subsequent violation $50.
Fine for animal waste littering: 1st violation warning; 2nd and subsequent
violations $50.
9.
Clubhouse: to be closed and locked 10 p.m. each night (except during special or
scheduled functions). Responsible adults may make prior arrangements with the manager to keep the clubhouse
open later if they will accept the responsibility of closing up when they are finished.
10. Curfew for minor children (under 18 years of age):
all minors are to be on their parents’ lot or the responsible adult’s lot by 11 p.m.
11. Lot Owner’s Responsibility:
regardless of whether owners are on-site or not, they shall be held responsible for their guest’s actions including
children or pets. Owners will be held financially responsible for damage to Lake Tyee property if the Board
of Directors of Lake Tyee places a damage assessment against them. Owner’s children and guests must
have “guest passes” if the parent/owners are not present. A second RV or tent trailer
(that has cooking facilities) on your lot is not allowed beyond three (3) days without prior approval from the manager
or designee. Fine for 2nd RV: 1st violation warning, 2nd
violation $500 plus $500 every month thereafter. Lot Appearance includes but is not limited
to general cleanliness, landscaping, condition and/or appearance of structures and/or RV’s, unsightly storage, grass
cutting, etc. Fine for lot appearance: 1st violation warning; 2nd
violation and/or failure to comply within 30 days is $250 and an additional $250 every 30 days thereafter until compliance.
Boats - there are two designated storage areas for boats. Boats must have a new
decal each year. They are to be removed from storage area and taken to lot owner’s lot November 1
thru February 28, otherwise, boats will be taken to impound area and $25 impound fee will apply.
12. Clearing,
Grading, Building: there shall be none except as provided in the “Declaration of Protective
Restrictions”. Your attention is called to this document, particularly regarding water & sewage,
signs, cuts and fills. If you do not have a copy, pick one up in the business office. The Board has appointed
the manager or designee to be its agent for control of these items. Fine Structure:
a. Building
without obtaining a Lake Tyee Building Permit: $250, compounding every thirty (30) days after time is given to correct violation.
i.e., $250 1st month, $500 2nd month, etc.
b. Not staying within the limits
of the approval of Lake Tyee: $250, compounding every thirty (30) days after time is given to correct violation,
i.e., $250 1st month, $500 2nd month, etc.
c. Stop Work Orders will
be issued for violations a and b. Defying a Stop Work Order will result in an additional fine of $500 and
a notification to the Skagit County Code Enforcement office when applicable.
d. According to
Skagit County Planning & Permit Center: Obtaining approval from the Lake Tyee Association does not fulfill your obligation
to obtain permits from the county.
13. Noise: use of building tools, chain saws, etc., are only allowed between 8a.m.-8p.m.
Monday-Friday; 9 a.m.-8 p.m. Saturday; and 10a.m.-8p.m. on Sunday. Fine: 1st violation warning,
2nd and subsequent violations $50. Loud and/or offensive noise or language:
1st violation warning, 2nd and subsequent violations $50.
14. Disorderly Conduct defined as “any nuisance,
breach of the peace, offensive or immoral conduct in public”. Fine: $100 per offense.
Abusive Conduct toward Lake Tyee Staff, Security personnel or volunteers in performance of their assigned
duties. Fine Structure: 1st $250; 2nd $500, 3rd $1000, each to be paid
in 10 days or access denied.
15.
Littering fine structure: 1st violation warning; 2nd and each
subsequent violation $50.
16.
Vandalism fine structure: 1st violation up to $500 plus reimbursement
of costs for repairing damaged property and possible criminal prosecution; 2nd and subsequent violations up to
$2000 plus reimbursement of costs for repairing damaged property and possible criminal prosecution.
17. Fish: Only one
rod and line is allowed per fisherperson and the limit is five (5) fish per day. Please don’t take
limits for your freezer, only enough for a fresh fish fry.
18.
There will be no camping on the “fan area” except by permission of Lake Tyee manager or designee.
In any case under Section 7.6 (fines) or 7.7 (liability for conduct causing common
expense) of Lake Tyee’s
By-Laws, where a fine of special assessment for misconduct is proposed, or under 4.5.2 (rights
and privileges-good standing) where a Member’s “good standing” status is proposed to be suspended, or in
any other case where the Board, in its discretion, deems necessary or advisable, an allegedly offending owner shall be afforded
the opportunity for a hearing by the Board of the Building and Covenants Committee to determine the appropriateness of the
action proposed to be taken. See Guideline #1 (Fines) for more details.
